General Conditions


The services provided by Morgale is governed by these General Conditions, the Contract Agreement, and the Price List available on the website.

Art. 1 - Object of the Contract:

Morgale, upon payment of the agreed price,

  1. rental: delivery to the Customer, at the agreed place, date and time slot, the Vehicle/Bicycle as identified above, equipped with the required accessories and the puncture repair kit, so that the Customer can use it according to the rental conditions agreed in the Contract and these General Conditions;
  2. guided tours: in addition to what is provided for the rental, provides a guide to accompany the participants on the chosen route, which may be subject to changes for safety reasons even during the journey.

Art. 2 - Booking Confirmation:

to confirm the reservation,

  1. rental: 100% of the amount indicated in the contract under Price;
  2. guided tours: a deposit whose amount is shown at the time of booking. The remaining amount must always and in any case be paid within 7 working days from the start of the tour.

Art. 3 - Deposit:

as a guarantee for the proper fulfillment of all obligations assumed by the Customer, a deposit amounting to €500 for Basso bikes, €1000 for Pinarello X7, and €1500 for Pinarello Dogma F and Dogma X is required at the time of booking.

Art. 4 - Cancellations:

If the Customer cancels the reservations made up to the 8th day before the start date of the rental, the entire amount paid will be fully refunded; the entire amount paid will be retained for cancellations within the last 7 days, while the deposit amount will be fully refunded.

In the event of intense weather phenomena forecasted in the area of use of the rented vehicles, to protect both the customer and the vehicles, both Morgale and the Customer may request a modification of the reservation with the cancellation of only the days affected by the phenomenon. Consequently, an amount equal to the rental price for the affected days will be refunded. In case of total cancellation of the reservation, the amount paid as a Deposit will also be refunded at the same time. In the case of a partial refund, the Deposit will be returned at the end of the rental period as usual.
The only source considered suitable for detecting this eventuality is the "Intense Phenomena Report" page of the Italian Air Force website at the following address: 

https://www.meteoam.it/it/segnalazione-fenomeni-intensi.
In this case, the amounts paid as both the Rental Price and the Deposit will be refunded only for the affected days.

In case of cancellation by Morgale until the day before the delivery date, Morgale will refund the entire amount paid by the Customer without any other amount, for any reason, being requested from the Customer. In case of cancellation on the same calendar day as the start of the rental or the delivery of the rented vehicle to the customer, Morgale undertakes to refund twice the amount paid as advance payment of the Rental Price and the exact amount paid as a deposit.

All the refunds of amounts paid as advance payment of the Price are to be considered net of management fees (5% of the amount).

Art. 5 - Customer Declarations and Obligations:

  1. the Customer declares to have examined the Vehicle/Bicycle and to receive it in excellent maintenance condition and perfectly functional at the time of signing this contract. Any defects found must be reported by the Customer to Morgale at the time of picking up the Vehicle and noted in writing at the bottom of the Contract;
  2. the use of the bicycle presupposes the physical suitability and technical expertise of the person intending to ride it. Therefore, by renting the bicycle and signing the Contract, the Customer declares to possess adequate skills and appropriate competence, without reservation, as well as to have all necessary equipment (e.g., suitable shoes) and to be perfectly capable of using them;
  3. in the case of use by minors, the parent/guardian or legal guardian of the minor, by signing this contract, assumes all responsibilities indicated in this contract and by the Italian Civil Code;
  4. Morgale may refuse to rent the Vehicle to a person deemed incapable of driving it in accordance with the Road Safety Law or for any other justified reason.

Art. 6 – Conditions of use:

  1. the presentation and delivery (via upload to the website or email) of a copy of one or more personal identification documents is a necessary condition for the service. Morgale may legitimately refuse to provide services if the documents presented in original do not correspond to those uploaded to the website or sent via email, without any claim being made by the Customer for any reason and without refund of the amount paid for the reservation as advance payment of the Price;
  2. the bicycle is to be used exclusively as a means of transportation and must be handled with care, common sense, and diligence, in order to avoid damage both to the bicycle itself and its related accessories;
  3. the Customer is obliged to comply with the rules of the Highway Code. The Lessor declines all liability in case of improper use of the vehicle or failure to comply with the rules of the Italian Traffic Laws;
  4. the Customer acts as the custodian of the Vehicle for the entire duration of the service;
  5. the maximum weight that bicycles can carry corresponds to 110 kg including the rider.

Art. 7 - Prohibitions:

  1. it is prohibited to use the bicycle in sporting events or for commercial activities;
  2. it is prohibited to lend the bicycle for use to other individuals;
  3. it is prohibited to use the bicycle for transporting dangerous substances, illegal goods, people, or goods for payment, nor can it be ridden under the influence of alcohol, sedatives, sleeping pills, or other substances that may affect the driver's ability to operate the vehicle;
  4. driving under hazardous conditions, including weather conditions that could damage the goods, is prohibited;
  5. participation in tours using your own vehicle is prohibited;
  6. except for the use of the Puncture Repair Kit, customers are strictly prohibited from interfering with the mechanical and non-mechanical parts of the rented Vehicle. It is understood that any intervention/modification carried out on the Vehicle or any of its parts will result in the application of the penalty clause as per Article 10.

Art. 8 - Customer Responsibility:

  1. the Customer is responsible for the bicycle until its return to Morgale; furthermore, they are responsible for damages caused to themselves, the bicycle, third parties, and property during the use of the vehicle. No form of compensation can be requested from Morgale. The customer also agrees to indemnify and hold Morgale harmless from any action taken against the latter for any fact and/or damage occurring to third parties during the use of the Vehicle;
  2. the Customer is aware that they do not have any insurance coverage deriving from this contract during the rental period.

Art. 9 - Return of the Vehicle:

  1. the user undertakes to return the bicycle and accessories within the time limits indicated in the Rental Contract, at the location specified under "Redelivery." The Customer may deliver the bicycle to another location, upon payment of a fee to be assessed based on the distance from the redelivery location, subject to agreement with Morgale to be made within 12 hours prior to the redelivery deadline;
  2. for the redelivery of the Vehicles and accessories outside the operating hours indicated by the reservation system, but still agreed upon with Morgale during the booking process, an additional payment described in the attachment "Morgale – Price Table" is required;
  3. any delays by the Customer in the redelivery of the Vehicles and accessories result in the payment of a penalty as described in Article 10 of these General Conditions;
  4. changes to the redelivery date and time must be agreed upon in advance with Morgale and may involve an additional charge;
  5. the Customer, who borrowed the Vehicle and accessories in good and mechanically efficient condition, undertakes to return them in the same condition (taking into account acceptable wear and tear, such as mud on the bicycle);
  6. upon the return of the bicycle and/or accessories, the lessor and the lessee inspect the vehicles for any damages. In case of damage to the Vehicle, the conditions of Article 10 of these General Conditions apply;
  7. the bicycle is considered returned only if returned directly to Morgale with the counter-signature of the redelivery on the contract. Failure to return the bicycle without prior communication or without justification from exceptional cases will be considered equivalent to a crime of misappropriation and therefore reported to the Judicial Authority;
  8. in case of theft of the bicycle during the rental period, the Customer must provide Morgale with a copy of the report filed with the competent authorities and pay an amount equal to the value of the stolen bicycle, which will be refunded in case of recovery or retrieval of the vehicle itself.

Art. 10 - Penalty Clauses:

for any damage caused to the Vehicles and accessories owned by Morgale, the Customer is required to pay a penalty; such damage may include theft, loss, breakage, damage, unauthorized modification, and scratching, except for normal wear and tear permissible with use. As compensation, Morgale is authorized to retain part or all of the amount paid as a deposit according to the quantification of possible damages listed in the document "Morgale – Price Tables" available on the website; except for the determination of additional damage that requires compensation greater than the amount paid, which obliges the Customer to make an additional payment until reaching the value of the confirmed damage.

Art. 11 - Intellectual Property and Trademark Clause:

  1. Trademark Rights: The name "Morgale," the related logo, and all related distinctive signs are registered trademarks in Italy and the exclusive property of Morgale di Amato Roberto. Use of the ® symbol next to the trademark indicates registration with the Italian Patent and Trademark Office (UIBM).
  2. Prohibition of Use: Third parties are expressly prohibited from copying, reproducing, distributing, publishing, or using the aforementioned trademark in any form or by any means, whether identical or similar (such as to cause confusion among the public), without the prior written consent of the owner.
  3. Site Content: All content published on this website (text, graphics, photographs, layouts, icons, and software) is protected by applicable copyright and industrial property laws. Trademark registration grants the owner the exclusive right to use it for the products and services specified in the registration application.
  4. Legal Protection: Any unauthorized use of the trademark or other distinctive signs, as well as counterfeiting or parasitic use, will constitute a violation of industrial property rights and will be prosecuted under the appropriate civil and criminal law, in accordance with applicable Italian law (Industrial Property Code - Legislative Decree 30/2005).

Article 12 - Applicable Law and Jurisdiction:

  1. This Agreement is governed by Italian law. For anything not expressly provided for herein, the provisions of the Civil Code and other applicable mandatory legal provisions shall apply.
  2. Any dispute that may arise between the parties in relation to the interpretation, validity, execution, or breach of this Agreement shall be referred exclusively to the Court of Bergamo.
